Terms of Use
Effective date: October 7, 2026
These Terms of Use ("Terms") govern access to and use of afterclassnetwork.com and all related forms, databases, communications, matching services, campaign services, and network functionality provided by After Class Network LLC, doing business as After Class ("After Class," "we," "us," or "our").
1. Acceptance; Additional Terms
By accessing the site, submitting a form, joining the network, requesting a campaign, accepting an opportunity, or otherwise using After Class, you agree to these Terms. Students, creators, athletes, alumni, and organizations are also subject to the Network Participation Terms. Brands and agencies are also subject to the Brand Campaign Terms. Campaign-specific proposals, statements of work, order forms, briefs, confirmations, or written agreements may add to or supersede these Terms for a particular engagement.
2. Eligibility and Authority
You must be at least 18 years old to join the After Class network unless we expressly approve otherwise in writing. If you act for a company, organization, chapter, team, club, agency, or other entity, you represent that you have authority to bind or act for that entity.
3. What After Class Provides
After Class may source, identify, organize, match, introduce, negotiate with, contract with, coordinate, pay, and manage students, creators, athletes, alumni, organizations, and brands. After Class may also provide campaign strategy, briefs, logistics, deliverable tracking, reporting, and related services. We may accept, reject, pause, or discontinue any application, campaign, or relationship in our discretion, subject to applicable contracts and law.
4. No Guarantee
We do not guarantee selection, opportunities, campaign availability, creator availability, participation, views, engagement, sales, downloads, signups, attendance, revenue, audience authenticity, platform distribution, or any particular result.
5. User Information and Verification
You agree to provide accurate and current information. We may verify identity, age, authority, social accounts, audience metrics, organization status, brand identity, payment details, or other information and may request supporting documentation. We may remove, suspend, or decline profiles or campaigns if verification is incomplete or information appears inaccurate, misleading, fraudulent, or unsafe.
6. Non-Circumvention and Protected Introductions
An "After Class Introduction" occurs when After Class identifies, presents, recommends, reveals the identity or contact information of, facilitates communication with, or otherwise connects a brand, agency, participant, or organization that was not already in a bona fide direct commercial relationship with the other party.
For 12 months following the most recent After Class Introduction, the introduced parties will not knowingly structure, redirect, or consummate substantially similar paid work arising from that introduction for the purpose of avoiding After Class fees or involvement. Such work must be booked through After Class or include the fee that After Class would otherwise have earned.
A pre-existing relationship is excluded only if it existed before the introduction and is disclosed to After Class in writing within five business days after the introduction. After Class may seek its unpaid fee, reasonable enforcement costs where permitted, and other available legal or equitable remedies for a breach. This section is not intended to prevent unrelated relationships independently developed without use of After Class information or introductions.
7. Intellectual Property
The After Class name, logos, website, databases, selection criteria, workflows, scoring systems, copy, designs, software, and other proprietary materials are owned by After Class or its licensors. Except for limited use necessary to use the services, no rights are granted. You may not copy, scrape, reproduce, reverse engineer, sell, sublicense, or exploit the network or database without written permission.
8. User Submissions
You retain ownership of materials you submit, subject to rights separately granted in campaign terms. You grant After Class a non-exclusive, worldwide, royalty-free license to host, reproduce, format, display, transmit, analyze, and use submitted information and materials as reasonably necessary to operate the network, evaluate and present opportunities, administer campaigns, prevent fraud, create internal analytics, and document performance.
9. Acceptable Use
- No scraping, harvesting, bulk exporting, or building a competing database using After Class information.
- No spam, harassment, discriminatory targeting prohibited by law, fraud, impersonation, phishing, or malware.
- No manipulation of engagement, signups, attendance, referral codes, screenshots, or performance data.
- No unauthorized sharing of confidential briefs, rates, contact details, or unreleased campaign information.
- No use of After Class to promote unlawful products, unlawful conduct, or deceptive advertising.
10. Communications and Electronic Signatures
You consent to receiving operational communications electronically. Electronic acceptance, checkboxes, typed names, click-through acceptance, and email confirmations may constitute signatures and written agreements to the extent permitted by law. Marketing communications will be handled separately where required.
11. Third-Party Services
After Class may integrate with payment processors, e-signature providers, analytics tools, social platforms, cloud services, and other third parties. We are not responsible for third-party services, outages, policies, data practices, content, or acts.
12. Compliance with Law
Users must comply with applicable advertising, consumer-protection, privacy, tax, employment, intellectual-property, NIL, platform, school, conference, event, product-safety, and other laws and rules. Nothing on the site constitutes legal, tax, accounting, employment, securities, or regulatory advice.
13. Suspension and Termination
We may suspend, restrict, or terminate access for fraud, abuse, non-payment, repeated non-performance, safety concerns, legal risk, circumvention, platform manipulation, or other conduct that we reasonably believe threatens the network or its users. Sections intended by their nature to survive will survive termination.
14. Disclaimers
To the fullest extent permitted by law, the services are provided "as is" and "as available." After Class disclaims all implied warranties, including merchantability, fitness for a particular purpose, non-infringement, accuracy, availability, and results.
15. Limitation of Liability
To the fullest extent permitted by law, After Class will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost profits, revenue, goodwill, opportunities, or data; platform suppression; failed campaigns; or acts of brands, participants, organizations, or third parties.
Except for liability that cannot legally be limited, After Class's aggregate direct liability arising from a claim will not exceed the greater of (a) fees actually paid to After Class by the claimant for the specific campaign giving rise to the claim during the six months before the event, or (b) $500 if no campaign fee was paid.
16. Indemnification
You agree to defend, indemnify, and hold harmless After Class and its owners, officers, employees, contractors, and agents from third-party claims, liabilities, damages, penalties, losses, and reasonable legal fees arising from your breach, content, instructions, products, claims, misconduct, infringement, legal violations, tax obligations, employment claims, or use of the services. After Class may control the defense of an indemnified matter.
17. Dispute Resolution; Informal Resolution
Before filing a claim, the complaining party must send written notice describing the dispute and requested relief to justin@afterclassnetwork.com and allow 30 days for good-faith informal resolution.
18. Binding Arbitration and Class-Action Waiver
PLEASE READ THIS SECTION CAREFULLY. Except for qualifying small-claims matters, intellectual-property claims, requests for temporary injunctive relief, collection of undisputed amounts, or disputes that cannot legally be arbitrated, disputes arising from these Terms or After Class will be resolved by individual binding arbitration administered by the American Arbitration Association under its applicable commercial or consumer rules, as appropriate. Arbitration may occur remotely unless the arbitrator requires otherwise.
You and After Class waive the right to a jury trial and agree that claims will be brought only on an individual basis and not as a plaintiff or class member in a class, consolidated, collective, or representative action, to the fullest extent permitted by law. [Counsel should add any required arbitration opt-out mechanism and consumer-specific notices before launch.]
19. Governing Law
To the extent not preempted by applicable arbitration law, these Terms are governed by Nevada law without regard to conflict-of-law principles. Court proceedings permitted under these Terms will be brought in state or federal courts serving Washoe County, Nevada, unless applicable law requires otherwise.
20. Force Majeure
After Class is not liable for delays or failures caused by events beyond reasonable control, including natural disasters, weather, illness, strikes, school closures, venue restrictions, platform outages, algorithm changes, internet failures, government actions, product recalls, shipping disruptions, or similar events.
21. Assignment; No Waiver; Severability
You may not assign these Terms without our written consent. We may assign them in connection with a financing, reorganization, merger, acquisition, or sale of assets. Failure to enforce a provision is not a waiver. If a provision is unenforceable, it will be narrowed or severed to the minimum extent necessary while the remaining provisions continue in effect.
22. Entire Agreement; Order of Precedence
These Terms, the Privacy Policy, applicable Participation or Brand Campaign Terms, and campaign-specific written terms form the agreement relating to the relevant services. Campaign-specific signed or expressly accepted terms control over conflicting general terms.
23. Changes
We may update these Terms prospectively. Material changes will be posted with a revised effective date and additional notice where legally required.
